OFFICIAL TERMS AND CONDITIONS
1. SPONSOR. Sponsored by the Milk Processor Education Program, 1250 H Street, NW, Suite 250, Washington D.C. 20005 (“Sponsor” or “MilkPEP”), administered by GALE Partners as Sponsor's agent.
2. PROMOTION PERIOD. June 30, 2026 at 12:00:01 AM ET through July 13, 2026 at 11:59:59 PM ET (“Promotion Period”). Physical Calendars are available only while supplies last.
3. ELIGIBILITY. Open to legal residents of the fifty (50) United States and District of Columbia who are at least 18 years of age at time of participation. Physical Calendars are available only to eligible participants with a delivery address in New York City (NY), Washington DC, Dallas (TX), Miami (FL), Chicago (IL), Los Angeles (CA), Atlanta (GA), Phoenix (AZ), and their surrounding GoPuff delivery areas (“Participating Delivery Areas”). Eligible participants outside the Participating Delivery Areas are eligible to receive a Digital Calendar, as described below. Employees, officers, and directors of Sponsor, GALE Partners, GoBrands, Inc. (“GoPuff”), Charles Melton, and their respective affiliates and agencies, and the immediate family and household members of each, are ineligible. Void where prohibited by law.
4. HOW TO PARTICIPATE. During the Promotion Period, participants may receive an automated direct message after posting a positive comment on the qualifying Instagram post, as determined by Sponsor or its service provider in its reasonable discretion. Commenting does not guarantee receipt of a direct message or a Calendar. The direct message will include a link to the Promotion microsite (the “Microsite”), where participants may follow the instructions to claim their Calendar offer. Eligible participants in Participating Delivery Areas must add a qualifying fluid dairy milk product to their cart and complete checkout through the Microsite to receive a Calendar: for the first five hundred (500) qualifying purchasers, a Physical Calendar will be automatically added to the participant's cart at no additional charge during checkout, while supplies last, and each subsequent qualifying purchaser will receive a Digital Calendar. Eligible participants outside the Participating Delivery Areas may receive a Digital Calendar through the Microsite without making a purchase. Sponsor is not responsible for delayed, failed, blocked, misdirected, or undeliverable direct messages, including due to Instagram functionality, user privacy settings, or automated filtering.
5. QUALIFYING PURCHASE. A “Qualifying Purchase” is the purchase of any fluid dairy milk product available through the Microsite during the Promotion Period. A Qualifying Purchase is required for participants in Participating Delivery Areas to receive any Calendar, whether Physical or Digital. No purchase is required for eligible participants outside the Participating Delivery Areas to receive a Digital Calendar. No cash alternative is available. Purchases are subject to applicable taxes, fees, and GoPuff’s applicable checkout terms.
6. AGREEMENT TO TERMS. By participating in this Promotion and/or completing a Qualifying Purchase, each participant agrees to be bound by these Terms and Conditions and the decisions of Sponsor, which are final and binding in all matters relating to this Promotion. Participants who do not agree to these Terms and Conditions should not participate in the Promotion.
7. CALENDAR OFFER FOR PARTICIPANTS IN PARTICIPATING DELIVERY AREAS; AVAILABILITY. Each eligible participant in a Participating Delivery Area who completes a Qualifying Purchase through the Microsite may receive one (1) Calendar, at no additional charge: for the first five hundred (500) qualifying purchasers, one (1) physical Milk Man 2027 Calendar ("Physical Calendar") will be automatically added to the participant's cart at checkout, while supplies last, and each subsequent qualifying purchaser will receive one (1) digital Milk Man 2027 Calendar ("Digital Calendar"). Physical Calendars are limited to five hundred (500) total and will be distributed on a first-come, first-served basis, based on completion of checkout and subject to verification. Limit one (1) Calendar per person/household. Sponsor reserves the right to verify eligibility and limit participation in the event of suspected abuse, fraud, or circumvention of these Terms and Conditions.
8. CALENDAR OFFER FOR PARTICIPANTS OUTSIDE PARTICIPATING DELIVERY AREAS. Eligible participants outside the Participating Delivery Areas may receive one (1) digital Milk Man 2027 Calendar ("Digital Calendar") through the Microsite without making a purchase. Digital Calendars are available through the Microsite until 11:59:59 PM ET on July 13, 2026. No additional compensation will be provided in lieu of a Physical Calendar.
9. NON-TRANSFERABILITY; APPROXIMATE RETAIL VALUE; TAXES. The Calendar and associated offer are personal to the eligible participant and are non-transferable, non-assignable, and may not be sold or redeemed for cash except as expressly stated in these Terms and Conditions. No substitution of the Calendar will be made except at Sponsor's sole discretion. The approximate retail value (“ARV”) of the Physical Calendar is $20. The Digital Calendar has an ARV of $0 or nominal value.
10. DELIVERY. Physical Calendar delivery is available only within the applicable GoPuff delivery range and only in connection with a completed Qualifying Purchase. Delivery of the purchased product and Physical Calendar will be fulfilled by GoPuff, not Sponsor. GoPuff delivery availability may vary by address and time. Sponsor is not responsible for unavailable delivery windows, GoPuff service limitations, incorrect or incomplete addresses, undeliverable items, or acts or omissions of GoPuff or other third parties in connection with fulfillment or delivery. Physical calendars will be delivered within the estimated delivery window provided at checkout. Risk of loss passes to participant upon delivery.
11. GENERAL CONDITIONS. Sponsor reserves the right to cancel, suspend, or modify the Promotion if fraud, technical failures, or other factors beyond Sponsor's control impair its integrity or functioning. Sponsor may disqualify any participant who Sponsor reasonably determines has tampered with the Promotion or otherwise acts disruptively. Sponsor's failure to enforce any provision shall not constitute a waiver.
12. RELEASE/LIMITATION OF LIABILITY. By participating, participants release Sponsor, GALE Partners, GoPuff, Charles Melton, Instagram, Meta Platforms, Inc. and their respective affiliates, agencies, officers, directors, employees, and agents (“Released Parties”) from any claim arising out of participation in the Promotion or receipt or use of any Calendar, including claims related to: (a) unauthorized human intervention; (b) technical or printing errors; (c) late, lost, or undeliverable items; or (d) injury or damage to persons or property. The Released Parties are not responsible for typographical or other errors in the Promotion's administration. THE CALENDAR IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE RELEASED PARTIES EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THIS PROMOTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
13. PRIVACY. Personal information collected through this Promotion, including information submitted through the Microsite and information necessary to process any Qualifying Purchase or deliver a Calendar, will be used to administer the Promotion and fulfill the applicable Calendar offer, in accordance with Sponsor’s Privacy Policy at https://milkpep.org/privacy-policy/ and, where applicable, GoPuff’s terms and privacy policy. Personal information may be shared with Sponsor’s agents, service providers, and fulfillment partners, including GALE Partners and GoPuff, as necessary to administer the Promotion, process the Qualifying Purchase, provide the Digital Calendar, deliver the Physical Calendar, or as otherwise required by law.
14. PLATFORM DISCLAIMER. This Promotion is not sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc. By participating, each participant releases Instagram and Meta Platforms, Inc. from any and all liability arising out of or relating to this Promotion. Participants provide information to Sponsor and/or its service providers, not to Instagram or Meta. Direct all Promotion inquiries to Sponsor.
15. GOVERNING LAW. These Terms and Conditions are governed by the laws of the District of Columbia, without regard to conflict of laws principles. Disputes shall be resolved exclusively in the state or federal courts of the District of Columbia. To the fullest extent permitted by law, any claims shall be brought in the participant's individual capacity and not as a plaintiff or class member in any purported class or representative action.
16. SEVERABILITY. If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be deemed modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms and Conditions, and the validity and enforceability of the remaining provisions shall not be affected.
17. OFFICIAL TERMS. These Terms and Conditions are available on the Microsite during the Promotion Period. Questions? Contact Contact@Gonnaneedmilk.com. Sponsor may update or clarify these Terms and Conditions as necessary to address technical, fulfillment, or operational issues, provided that any update does not materially disadvantage participants who have already participated.
18. ENTIRE AGREEMENT. These Terms and Conditions constitute the entire agreement between each participant and Sponsor with respect to this Promotion and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written, relating to the subject matter hereof.
